Terms of Service
Last updated:
These Terms of Service (“Terms”) are an agreement between you and BahtTap (“BahtTap”, “we”, “us”). They apply when you or anyone in your business uses the BahtTap app, website and related services (the “Service”).
BahtTap is not yet generally available. These are our interim terms for early access, and we’ll update them before launch. They take effect on 19 October 2026.
Accepting these terms
By creating a BahtTap account, or by using the Service on behalf of a business, you agree to these Terms and confirm that you can act for that business. If you don’t agree, don’t use the Service.
Who can use BahtTap
- The Service is for businesses and sole traders operating in Thailand.
- You must be at least 20 years old, or otherwise legally able to enter into contracts under Thai law.
- You must pass the identity and business checks we or our payment partner ask for, and keep the details you give us accurate and up to date.
- You must not use the Service if Thai law or any sanctions regime prohibits you from doing so.
Your account
- You sign in with your Google account (or Apple account on iPhone). Keep that account secure, and tell us straight away at support@bahttap.com if you think someone else has used it.
- You’re responsible for everything done through your BahtTap account, including by anyone you let use your phone.
- Each account is for one business.
Devices
- Taking payments needs an Android phone with NFC, running Android 8.0 or later, that passes our device integrity checks.
- Don’t use the Service on a phone that is rooted, emulated or otherwise modified to get around security controls.
- We may stop a phone from taking payments if it fails integrity checks or we suspect misuse.
Taking payments
- Card payments made through BahtTap are processed by our licensed payment partner. BahtTap never receives full card numbers: card details are read and handled by our partner’s software.
- A payment is complete only when our payment partner confirms it as approved. What the app shows at the moment of the tap can change if the partner reports a different result, and the partner’s confirmation is what counts.
- We may set limits on how much you can take per payment or per day, and pause payments for everyone or for one business if we need to (for example to investigate a problem).
Payouts
- We pay approved sales, less our fee and any refunds, to the PromptPay account you registered when you signed up.
- Payouts are made in baht on our payout schedule, which the app shows. A sale appears in the app as waiting for a payout until it’s included in one.
- If the name on your PromptPay account doesn’t match the name you gave us, we may hold payouts until we’ve checked it.
- If a refund or chargeback happens after a sale was paid out, we may take the amount from your next payouts, or ask you to repay it.
Fees
- Our fee is a percentage of each approved card sale, shown in the app on each sale (currently 3.5%). It’s taken from the sale before payout.
- There’s no monthly fee and no charge for the app.
- We’ll give you at least 30 days’ notice before we increase our fees.
Refunds and chargebacks
- You can refund a sale in full from the app within 30 days of the sale. The customer gets the money back on their card, and you can show them a refund receipt.
- You’re responsible for chargebacks and disputes about payments your business takes, and for keeping evidence of the goods or services you provided.
Referral programme
You can invite other businesses to BahtTap with your referral code or link.
- Reward. When a business signs up with your code and makes 10 qualifying sales within 30 days of starting, you and that business each get ฿100.
- Qualifying sales. A sale counts only if it is:
- an approved card sale of at least ฿20, that isn’t later refunded or charged back;
- on a customer’s card that hasn’t already counted for that business (each card counts once, and the 10 sales need at least 7 different cards);
- one of no more than 5 sales counted in any hour, with the 10 sales spread over at least 3 different days; and
- taken on a phone that passes our device integrity checks.
- Hold period. Rewards are held for 14 days after the business qualifies, so refunds and chargebacks can be taken into account, and then paid with your next payout.
- Limits. One reward per referred business. You can earn up to 10 rewards a month; any more wait for the next month. You can’t refer your own business, or one that shares your phone, phone number or payout account.
- Abuse. If we reasonably believe a reward came from fraud, self-funded or test sales, or other attempts to game the programme, we may cancel it, take back a reward already paid and suspend the accounts involved.
- Changes. We may change or end the programme at any time. Changes don’t affect rewards already paid.
- Tax. You’re responsible for any tax due on rewards you receive.
Acceptable use
Don’t use the Service to:
- sell goods or services that are illegal in Thailand, or that our payment partner or the card schemes don’t allow;
- take payments that aren’t for a genuine sale by your business, including cash advances or payments you fund yourself;
- split one sale into several payments to get around limits;
- interfere with, reverse engineer or try to get around the security of the Service; or
- defraud or mislead customers.
Availability and changes to the Service
We work to keep the Service running, but we can’t promise it will always be available or error-free. Payments depend on our payment partner, the card schemes and mobile networks, which we don’t control. We may change features, and we’ll tell you in advance about changes that significantly reduce what the Service does.
Intellectual property
The Service, including the app, website, software and brand, belongs to us or our licensors. We give you a limited, non-exclusive, non-transferable licence to use it for your business while these Terms apply. Your business data stays yours.
Suspension and closing your account
- You can stop using the Service and delete your account at any time. See Delete your account. We’ll still pay out money we owe you.
- We may suspend or close your account if you break these Terms, if our payment partner or the law requires it, or if we reasonably suspect fraud. Where we can, we’ll tell you why first.
- Parts of these Terms that by their nature should continue after your account closes (such as amounts owed, refunds, chargebacks, liability and governing law) continue to apply.
Disclaimers
As far as Thai law allows, the Service is provided “as is”, and we don’t promise it will meet your particular needs.
Limitation of liability
As far as Thai law allows:
- we’re not liable for indirect or consequential loss, or for lost profit, revenue or goodwill; and
- our total liability to you in any 12-month period is limited to the fees you paid us in that period.
Nothing in these Terms limits liability that the law doesn’t allow us to limit, including for fraud or gross negligence.
Indemnity
You agree to cover our losses arising from your breach of these Terms, your sales to customers, or customer claims about goods or services you provided.
Governing law and disputes
These Terms are governed by the laws of Thailand. The courts of Thailand have jurisdiction over any dispute.
Changes to these terms
We may update these Terms. We’ll tell you about significant changes at least 30 days before they take effect, in the app or by email. If you keep using the Service after that, the new Terms apply.
